Investigating and responding to an incident can be complex and costly even before legal defense expenses and regulatory fines and penalties begin to accrue. An effective data breach response is a complicated process. It is fast moving and involves a carefully coordinated set of decisions. Forty-eight states have enacted security breach notification legislation. The law varies by state and notification to affected individuals in some states is no later than 45 days.

Privacy breach response service

  • Legal and computer forensic services from a panel of experts to help determine the extent of the breach and the steps needed to comply with applicable laws or regulations
  • Notification to persons who must be notified under applicable law
  • When a breach does not trigger any legal duty to notify, coverage includes discretionary notice to individuals potentially affected by the breach
  • Resolution and mitigation services, including one and three bureau monitoring and identity monitoring solutions.
  • Identity theft-related fraud resolution services for individuals enrolled in credit monitoring who become victims of identity theft
  • As an alternative to credit monitoring, the insured may select to offer 12 free months of identity monitoring, including fraud support services for enrolled individuals

Frequently Asked Questions

If my firm purchases E&O coverage, wouldn’t this policy protect us in the event of a cyber or privacy breach?

This is often a misconception by policyholders and we find that the majority of errors & omissions policies do not cover cyber or privacy breaches. An E&O policy typically limits coverage to claims arising from negligence in the performance of specifically defined services and excludes coverage for criminal or intentional acts of insured’s or their employees.

What are my obligations in the event of a breach to report such and to whom?

47 of 50 states require a breach to be reported to those affected if any personal identifiable information (PII) is leaked. Any company who does not report these breaches is subject to hefty fines and penalties from various state and industry regulators. If you are a firm servicing clients in multiple states, a single breach can be costly in just legal expenses to translate the requirements of each state’s law. Having the proper Cyber Privacy Liability coverage in place can provide assistance and help cover these expenses.
